General Terms of Use

Registration with UbiMap and use of its solution are subject to the following General Terms of Use and General Terms of Sale.

The general terms below constitute a contract between UbiMap and users of the https://ubimap.fr website and the services directly related to it.

The terms "UbiMap" and "we/our" refer to the company UbiMap.

Using our services implies full acceptance of the General Terms of Use (GTU) described below. These GTU may be modified at any time, and registered users will be notified by email to review, approve, or reject them.

Service interruptions for maintenance may be scheduled at any time, and customers will be notified in advance of the dates and times of such interventions.

The website https://ubimap.fr aims to provide information about all the services UbiMap offers. UbiMap strives to provide the most accurate information on this site; however, it cannot be held liable for omissions, inaccuracies, or updates, whether they are its own or those of partner third parties providing this information.

All information on the website is for informational purposes only and may change. Moreover, the information on this site is not exhaustive and is subject to modifications since its publication.

Our services shall not be held liable for material or software damages linked to their use, resulting from either inadequate equipment, bugs, or incompatibility. The user agrees to access our services using hardware free from malware and a recent, up-to-date web browser.

UbiMap disclaims liability for indirect damages (such as loss of a business deal) resulting from the use of the website https://ubimap.fr and associated services.

UbiMap reserves the right to moderate any content posted on its software platform that violates applicable French law (messages of a racist, abusive, defamatory nature, data obtained illegally or unfairly, etc.) without prior notice, regardless of format.

The services offered by UbiMap may contain hyperlinks to other online resources. However, UbiMap cannot verify the content of these resources visited by the user and, therefore, assumes no responsibility in this regard.

General Terms of Sale

If you subscribe to a paid UbiMap license directly from the subscription interface, the commitment period is three months, effective from the date of credit card payment.

This initial commitment period may vary if the UbiMap user has signed a specific contract with a UbiMap representative or affiliate. Upon expiration of the initial commitment term provided in the specific contract, the user is tacitly committed for one year. If the user initially opted for monthly payments, this payment method will continue throughout the subscription (annual payment with two months free is available upon request).

Any termination or removal of the payment method before the end of the minimum commitment period will result in automatic billing of the outstanding balance.

Terminating the license results in the loss of UbiMap credits, which remain valid until the renewal anniversary date. However, license termination does not block access to the UbiMap solution.

The paying user has 30 calendar days to notify [email protected] (or the account manager’s email address) of their intent not to continue the UbiMap subscription beyond the initial commitment period.

Any interruption of payment before the end of the commitment period will result in a demand for payment and possible legal action.

The maximum contract execution period for UbiMap is six months from the day the estimate or other written commercial agreement is signed. After this period, UbiMap will issue a new commercial proposal. Under no circumstances will UbiMap be liable for any advance or other payments related to the contract if not executed within the time limit.

UbiMap use is limited based on credits indicated in the "Subscription" section within the software solution.

A credit is consumed only once the data is obtained, and unused credits roll over to subsequent months until used (except for subscriptions before 28/12/2021 or as specified in contracts).

Credits are renewed along with the subscription, i.e., monthly for monthly subscriptions and annually for annual subscriptions (unless specified otherwise in contracts).

UbiMap reserves the right to change the credit calculation basis or the number of credits granted, depending on the costs of its technical partners, and to add or remove technical partners as needed.
